Acceptance of Terms

By downloading, installing, accessing, or using the BooksByAma mobile application or website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. These Terms form a legally binding agreement between you and BooksByAma.

If you do not agree to these Terms, you must immediately stop using the Service and uninstall any downloaded copies of the BooksByAma application. If you are accepting these Terms on behalf of a minor child, you represent and warrant that you are that child's parent or legal guardian and that you accept these Terms on their behalf.

Eligibility

To register for a BooksByAma account directly, you must be at least 18 years of age. The Service is intended to be used by children under the supervision of a parent or legal guardian who creates and manages the child's profile.

• You must be 18 years or older to create a parent or educator account.
• Child profiles may only be created by a registered parent or guardian account holder.
• School and institutional accounts must be created by an authorised representative of that institution.
• You must have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
• BooksByAma reserves the right to refuse Service to any person or entity at our discretion.

User Accounts

To access the full features of the BooksByAma Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials, including your password.
• You are responsible for all activities that occur under your account and any child profiles linked to it.
• You must notify us immediately at hello@booksbyama.com if you suspect any unauthorised use of your account.
• You may not transfer, sell, or assign your account to any other person or entity.
• You may not create more than one account per person unless expressly permitted by BooksByAma.

BooksByAma will not be liable for any loss or damage arising from your failure to keep your account credentials secure.

Acceptable Use

You agree to use the BooksByAma Service only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Service. The following activities are strictly prohibited:

• Using the Service for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
• Attempting to gain unauthorised access to any part of the Service, its servers, databases, or connected systems.
• Transmitting any unsolicited or unauthorised advertising or promotional material.
• Introducing viruses, malware, trojans, worms, or other harmful or malicious code into the Service.
• Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the Service.
• Scraping, crawling, or using automated means to access or extract data from the Service without our express written permission.
• Impersonating any person or entity or misrepresenting your affiliation with any person or entity.
• Using the Service to harm, harass, abuse, or threaten any individual.

BooksByAma reserves the right to investigate and take appropriate action against anyone who violates these provisions, including suspension or termination of their account.

Intellectual Property

All content available through the BooksByAma Service — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software — is the property of BooksByAma or its content partners and is protected by applicable intellectual property laws.

What You May Do

• Access and read content through the Service for personal, non-commercial use.
• Download books for offline reading within the app on your registered device.
• Share links to the BooksByAma website or app stores for promotional purposes.

What You May Not Do

• Copy, reproduce, distribute, publish, or display any content from the Service without our prior written consent.
• Modify or create derivative works based on any content from the Service.
• Remove or alter any copyright, trademark, or other proprietary notices from content.
• Use any BooksByAma trademarks, logos, or brand assets without our express written permission.

User Content

If you submit, upload, or otherwise make available any content through the Service — such as feedback, book reviews, or communications with our support team (“User Content”) — you grant BooksByAma a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display that User Content for the purposes of providing and improving the Service.

You represent and warrant that:

• You own or have the right to submit the User Content.
• The User Content does not infringe any third party's intellectual property rights, privacy rights, or other legal rights.
• The User Content does not contain harmful, offensive, discriminatory, or unlawful material.

BooksByAma reserves the right to remove any User Content at our discretion without notice.

Third-Party Services

The Service may contain links to third-party websites, services, or content that are not owned or controlled by BooksByAma. These links are provided solely for your convenience.

BooksByAma has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to review the terms and privacy policy of any third-party website you visit.

Disclaimers

The BooksByAma Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, BooksByAma expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
• Any warranty regarding the accuracy, reliability, or completeness of any content available through the Service.

We do not warrant that any errors or defects in the Service will be corrected, or that the Service will meet your specific requirements.

Limitation of Liability

To the maximum extent permitted by applicable law, BooksByAma, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

This includes, without limitation:

• Loss of data or content
• Loss of revenue or profits
• Loss of business or opportunity
• Personal injury or property damage
• Any unauthorised access to or use of our servers or any personal information stored therein
• Any bugs, viruses, or other harmful code transmitted to the Service by any third party

In jurisdictions where limitations on liability for incidental or consequential damages are not permitted, BooksByAma's liability shall be limited to the maximum extent permitted by law.

Account Suspension & Termination

BooksByAma reserves the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any of the following reasons:

• Violation of these Terms of Service or our Community Guidelines
• Providing false or misleading information during registration
• Engaging in fraudulent, abusive, or harmful conduct
• Non-payment of subscription fees after the applicable grace period
• Any conduct that we determine, in our sole discretion, to be harmful to other users, third parties, or BooksByAma

Account Deletion by You

You may delete your account at any time through the app settings or by contacting our support team. Upon deletion, your data will be handled in accordance with our Privacy Policy. Active subscription fees are non-refundable except where required by applicable consumer protection law.

Changes to These Terms

BooksByAma reserves the right to modify these Terms at any time. We will provide notice of significant changes through one or more of the following methods:

• An in-app notification displayed to all users when they next open the application
• An email notification to the registered email address associated with your account
• A prominent notice posted on our website
• An updated “Last Updated” date at the top of this page

Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and may delete your account.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may refer the matter to the courts of competent jurisdiction in Accra, Ghana.

Nothing in this clause shall prevent either party from seeking emergency injunctive or other urgent relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
